Legal Question in Criminal Law in Texas

A relative was arrected while driving from tx to okla, he went into a convenience store and when he came out, they stopped him because he has tatoos on his arms and told him he looked like a gang member. he was charged because he had two tylenol w/ codiene in his clothing bag and an antique pistol, unloaded under the truck seat. they are charging felony's. what should he expect to happen.

There are several legally interesting factors to your scenario.

It is impossible to predict what will happen, but he certainly needs a retain lawyer asap.

If the original stop is bad, then the resulting search should be bad. HIs lawyer can explain to him the legal requirements of a stop, and what the police officers will articulate those reasons were. That testimony will have to be weighed against the testimony of witnesses. If his lawyer can establish that the stop was bad, it could result in a dismissal of charges.

If not, then he still has options, including whether or not there were scripts for the pills.
