Legal Question in Criminal Law in Texas

removing misdemeaner charge from record in Texas

My husband has a class C misdemeaner charge for possession of marijuana under 2 oz in 1999 from Wallis Texas. Is there any way to get that removed. We have applied for low income housing and got denied because it is still on his record. Isn't there a way to get something dropped off after 7 years or is that just a myth?

Re: removing misdemeaner charge from record in Texas

There is no such offense as a class C misdemeanor offense of possession of marijuana under 2 oz. There is however a class B misdemeanor offense, but no conviction for any offense just automatically drops off after 7 years, the conviction remains on an individual's record for life. You might want to contact a criminal attorney in your area and discuss with them about a possible petition for non-disclosure.
