Legal Question in Criminal Law in Texas

resisting arrest or transportation

Look I need some help. I'm 29 years old and was arrested for some tickets inside my garage at my apaertment. At the time my wife was across the parking lot talking to one of the other officers and my children were in the apartment they kept coming out to find out what was going on and I was sitting in the garage in a chair I'd tell the to step back inside. I'm being charged for resisting because when the oficers stepped into the garage I told them to leave and my kids tried to come out to see if everything was ok I said no and pulled the door back shut and then the officers rushed me. Now the tickets are paid off and I'm facing this charge in two weeks. I can't afford an attorney due to my wife leaving me over the incident of this arrest.

I was denied a court appointed attourney due to their decision that I am not indegent so I need to know what to do now.

Re: resisting arrest or transportation

If you want to fight this charge, then you need to find a way to hire a lawyer.

If you are willing to plead no contest, and take deferred adjudication, then you can go to the first court appearance and advise the ADA that you would like to deferred disposition. After you successfully complete the probation time (probably 12 - 18 months), pay the fine and court costs, then the charge will be dismissed. The arrest will NOT come off of your record. If you violate the probation, then the full range of punishment is available to the judge.

If the ADA refuses to recommend deferred, then straight probation will include a misdemeanor conviction.
