Legal Question in Criminal Law in Texas

Restitution

I have been on deferred adjudicated probation since 12/99 and it is scheduled to end on 12/09. I still owe $9007 in restitution to the victim but all court fees, etc were paid long ago since my account was messed up. Is there anything I can do - I am not working since March 09 - to keep from going to jail since I have no way to come up with $9k

Re: Restitution

what do you mean your account was messed up? Why have you not been paying your restitution?

An attorney I office with recently argued a similar situation to a judge where a defendant was ordered to pay around $500k in restitution but ordered to pay it at around $1k per month for 10 years of probation. He paid on time for the full ten years but they then tried to violate him since he hadn't covered the full restitution. The argument was that he paid what he was ordered to pay in the manner he was ordered to pay it, if the state screwed up the calculation, the defendant should not be held responsible. The judge agreed....

I dont know if that is what you mean by your account being screwed up, so I am just taking a guess.
