Legal Question in Criminal Law in Texas
Retreival of evidence
Cashiers checks are being held as evidence by Postal inspectors in a fraud case. Can a court order be obtained to force the return of the original checks to the victim of the fraud? It would result in the recovery of funds exceeding $100,000.

Re: Retreival of evidence
Probably not at this time. The court could give the original checks back to you at some point after the case is disposed of. It is highly unlikely that any judge would give you a court order to return evidence of a crime PRIOR TO disposal of the case. Be patient, you'll eventually get them back.
