Legal Question in Criminal Law in Texas

Reversal of conviction

I was caught shoplifting about a year ago. I ended up in the ER becuse of a panic attach. I was given a citation. I was never read my rights, nor was I arrested. I whent to court in March and was assigned a court appointed atty. I was called by his paralegal, and I gave her my story. When we went to court in May my atty more or less told me to take what the DA was offering, I did not want to because of some mental problems that I had never had the chance to tell the DA or the judge, my atty did nothing. do I have a case to try and get this overturned.

Re: Reversal of conviction

You can appeal as long as you file your notice of appeal within 30 days of your sentence. Other wise you may want to consider a writ of habeas corpus (although a writ is very expensive option and you may decide that it is not worth the cost for a Class C Misdemeanor).
