Legal Question in Criminal Law in Texas
Rights to a Criminal File
My husband has been incarcerated for over 12 years. During that time, we have attempted on numerous occasions to obtain his criminal file from the 2 attorneys. Neither attorney will turn over the file. In 1999, the lead attorney committed suicide. Now the probate attorney refuses to turn over the file or allow me to purchase a copy.
I was told by the State Bar of Texas that we have a right to the file. How can I obtain this file if the attorney's refuse to grant me access?

Some of the information in the file is protected by the attorney - client privilege and cannot be released without your husband's approval.
