Legal Question in Criminal Law in Texas
Rights
My 16 year old son was arrested at his school for possesion of cocaine. He said he was holding it for someone. They never read him his rights or said he was under arrest. They have charged him with a felony. They cuffed him and finger printed etc. Is this right? where do we stand with this?

He should be charged as a juvenile, and by now released back into your custody. It doesn't matter that he was holding it for someone else, it was in his possession. You need to get him a lawyer. If you don't, the court will appoint him a lawyer, and probably have you pay it at the end of the proceedings. But then, the attorney will not be of your choosing, but the judge's choosing.
