Legal Question in Criminal Law in Texas
Road Rage
I was searching for a parking space, when a vehicle drives the wrong way head on with me. Last second he turns away barely missing my front bumper and rolls down his window inches from my drivers side window and begins to scream ''you fkin white bitch'' so on etc... and hits my side mirror with his fist and shatters it. I was scared to death. My body shaken and not realizing for a second what was happening. He then begins to drive off. Once I retained my wits I turned around my vehicle and followed him to get his lis. plate number. He then jumps out of his truck screaming again. I called 911. The police came and made a report. I was told I could pick up my report next week. I am still shaken from the accident. I am a 41 year old professional woman, married and with 2 kids. I left scene very shaken and felt hopelss with no rights... I want to take action against this african american man that is totally out of control. Can you please advise me of my rights.
The man was not cited with a violation. I was told since he did not do bodily injury there was nothing the police could do????

Contact your local criminal district or county attoney's office and attempt to file charges yourself after you get a copy of the report. Under the penal code that was assault.
