Re: Robbery with a deadly weapon

In Texas the charge would be Aggravated Robbery, which is a first degree Felony. It carries a range of punishment of 5 to Life or Probation if the Defendant is probation eligible. That is, the range of punishment is from probation to life in the pen if the Defendant has been before been convicted a felony in this state or any other state.

Note, aggravated robbery is a "3g" offense, for which only a jury can give straight probation. Therefore, I judge could NOT give straight probation. However, I judge could give deferred adjudication probation.
