Legal Question in Criminal Law in Texas
My roommate was arrested for possession of child pornography. During the arrest I was at work and the police seized my roommate's laptop and mine which was in the living room. I called the detective handling the case and asked him what I need to do to get my laptop back but he said it's going to a crime lab to be searched and I should get it back in a couple of weeks. After a month I called again and said he there was no evidence found on my laptop but he could not release it to me I called several times but the detective will not let me have my laptop back. It's been a year now and the police will not give me my laptop. As far as I know, my ex roommate has not been indicted. What can I do to get my laptop back?

I suggest you get a criminal defense attorney in your area that is familiar with this offense.. Just because the police say that no evidence has been found does not mean that did not find any or no longer looking. You may still be charged. Even if they find nothing, the state may try to impute possession of the child porn to you because it was found in your residence.
