Legal Question in Criminal Law in Texas

Search Warrants

My home was searched on Feb,5th and they found 3oz,of meth. I was not arrested at the time. Now I recieved a call that they have filed the case with the Dist.atty.Heather Ratan. If I was not arrested that night nor was ever charge, how can they wait this long to file on me?. They did not even read me my rights that day.

Re: Search Warrants

The police can wait to arrest you. They only need to read your rights when they plan to ask you questions. The police are not required to arrest you right away; they may wait until they feel that they have their best case. You need an attorney ASAP.
