Legal Question in Criminal Law in Texas
Seeking legal help for granddaughter
2 years ago my 16 year old granddaughter was in some trouble and charged with 2 felony counts. Put on probation and parents paid restitution. Recently an acquaintance stole some checks and forged them. This girl gave a statement to police that my granddaughter had no part in stealing or forging the checks. Now police have issued a warrant for her arrest saying she"profited" from the theft of checks because a meal was paid for with one. Has appeared in local paper my granddaughter has been arrested, arraigned, bond posted. None of this has yet taken place. We are seeking an attorney and her parents do not have a lot of money. Can the local police do this to her? What are her legal rights? We desperately need help. We do not want her to go to prison. She is now 18.

Re: Seeking legal help for granddaughter
The police can try and do this. The real issue here is, did she know that the "freind" was paying with a forged check. If she did, she may well be an accesory to the crime.
In your post you fail to mention where this travesty is taking place, if it is in Central Texas, I am fairly sure that she would not go to prison over this, if she is in fact guilty. The key thing is for you to hire a good attorney, not a cheap one. If you are outside of the Central Texas Area I would be happy to refer you to someone who is qualified(if I know any one). If you live around the Austin area , I would be happy to help.
