Legal Question in Criminal Law in Texas
sentencing
My nephew just recently was sentenced by a judge for 16 years in prison for taking pictures of and fondling a 15 year old child. He pleaded guilty and it was his first offense. Since he pleased guilty and the judge sentenced him, is there any way to go to appeal on the severity of the sentence

Re: sentencing
Not likely.
If the sentence was the result of a plea bargain, then he has waived his right to appeal. If it was an open plea with a contested sentencing, then errors in sentencing can be appeal. If the only error is a disappointment with the result, then no. Have a criminal defense attorney review the record.
There are strict deadlines, so if it is going to be reviewed, needs to happen immediately.
