Sentencing
Can you be sentenced to a certian time based on you previous arrests (not convictions)? The judge gave a sentence of 6 years based on background and the current offense. Can the judge use background to sentence you?

Generally, yes the judge can use the defendant's background in sentencing. Typically, when a defendant has a long history of criminal activity, the judge will "enhance" the sentence.
