Legal Question in Criminal Law in Texas

A young man is guilty of felony poss. of marj.. can the judge sentence him to enter the military if the young mans attorney asks the judge to consider this. No prior convictions and the young man is willing. (over 4 ozs than 5 lbs)

Judges have wide discretion at times for certain offenses.
This offense falls into a category called state jail offenses and has a punishment range anywhere from 180 days to 2 years in a state jail facility or probation.
In your case it sounds like the judge wants to give the individual a break and let him enter the military to avoid a conviction out of some hope the service will straighten him out.
However, the judge does not have the power to force someone to do this.
