Legal Question in Criminal Law in Texas

sex offenders living with children

my boyfriend and I have been together for over 2 years. He is a registered sex offender whose crime in no way involved children and occurred over 20 years ago. Recently my boss found out about my boyfriend's status and said that I am breaking the law - that a registered sex offender in Texas cannot live with a child in the house. She has me scared as she said CPS could take my child. And threatened that if I moved with him, se would report me.

My boyfriend said her accusation was ridiculous and that no such laws exist. The only way that a sex offender would not be allowed to live with a child in the household was if it was a condition of his release, parole or probation. My boyfriend is not under any type of supervision what-so-ever. Who is right and am I breaking the law? My child is my life, and I do not at all like the threat. Please help.

The current duty to register as a sex offender and up keep that info is in under TX Code of Criminal Procedure Chapter 62. You should review that chapter to see what the specific requirements are for whether or not your boyfriend can live in the same household.
