Legal Question in Criminal Law in Texas

My boyfriend has a criminal record 8 miles long. A couple state jail felonies, and a few marijuana charges, but, nothing to a violent content. He has been in county for 5 months on a sexual assault case, the girl says he raped her but my boy friend said he would agree to a DNA test and yet 5 months later he still has not been indited, and nothing has been done on his case, I talk to his court appointed attourney and he says for us just to sit back and let him do his job, kind of hard when my boy friend is sitting there screaming dna. Then his attourney said that there never was any dna for this case in the first place, she never had a rape kit done. What can I do to try and help my boyfriends case move quicker. How long do they have to indight him? Someone also told me they may not be able to indite him.

Get him a retained attorney, and pay him enough money to truly work the case.
