Legal Question in Criminal Law in Texas

sexual assult allegations

Allegations of sexual assult of a child ( i think in the teen age range and consenual). Just on allegations alone what are the chances that the d.a. would accept the charges? As of now it appears to be a he said/ she said kinda deal?

Re: sexual assult allegations

You have asked a very general question which is dependent on a very specific situation. It is impossible to answer. For what it is worth, ADA's accept cases all the time that rely upon 'he said/she said'. So does the Grand Jury. It depends upon the credibility of the information obtained. Often times an ADA will even take a 'loser' case to trial, so that the judge or jury can take responsibility for the loss.

If this allegation has been lodged against you or someone close to you, there should be an attorney involved immediately. The consequences can last a lifetime.

Any attempt to answer this question would only be a guess. It would just depend upon how the prosecutor viewed the case and the strength of the evidence. He said/she said cases get indicted and wind up in court all the time. Also, if the child is under 17, then in most circumstances, the fact that it was consensual is no defense to prosecution. This is a very serious case and you should get a lawyer. And you should absolutely not speak to any investigators without first consulting a lawyer.
