In the state of Texas, is it a crime to have sex with a 17
year old girl if a man is 38 and she consented to having sex with him.

Texas Penal law makes it an offense to have sexual contact with a child. In section 22.011 of the Texas Penal Code a "child" is defined as one below the age of 17 years old.
