Legal Question in Criminal Law in Texas

shoplifting

My daughter is in jail for shoplifting a book, cd and a pair of jeans at Target. She is 22 years old. I want to know what the legal process is and what will happen to her.

Your answer all depends on the strength of the case against her and any prior records. With a clean record and a weak case it will either be reduced to a trespass or be dismissed assuming she goes to trial. With a strong case, the case will probably be reduced to a petty theft misdemeanor, burglary charges if any will be dropped and she will be placed on summary probation.

It depends upon her lawyer, the DA and her past history. It also depends upon whether there is sufficient evidence to convict her. If there is, and she has good representation, then in a best case she might get the charges knocked down to a Class C, get it changed to a non-moral turpitude offense, and get deferred. She needs a lawyer.

The first step in the process is whether the judge will issue reasonable bail in CA. After that, will come arraignment. Regardless, it will depend on the county of CA you are in, the prosecutor, and if your daughter has any prior criminal history. Regardless, your daughter needs an attorney immediately, this can affect her life now and in the future.
