Legal Question in Criminal Law in Texas

Shoplifting by a seventeen year old

My daugher (who just turned 17) recently was caught shoplifting about $20 of makeup at Target. We go to court next week and I need to know if she needs a lawyer and what kind of sentence she is facing. Can she receive deferred adjudification w/o having a lawyer? Also, should she plead guilty or no contest to the charge.

Re: Shoplifting by a seventeen year old

It depends on what county and who the judge and prosecutor are. However, generally she will get deferred probation for a simple shoplifting case. If she has a record, she may not get deferred probation.

The offense she is charged with carries a range of punishment of 0 to 180 days in jail. Its a class B misdemeanor.

Your daughter needs an attorney to handle the case. If she gets a conviction on her record, it will never come off and can affect her future employment status.
