Legal Question in Criminal Law in Texas
shoplifting
My son (age 17) and his friend (age 18) were arrested for shoplifting at a retail store. They are charged with Theft$50/$500. My son had jeans and a shirt (retail under $50 total)in his bag and friend had a shirt (retail $13.99)he had taken. Therefore, altogether they had more than $50. My questions: Is it correct to charge them both for all 3 items or should it be what each of them indiv. stole? Also, if the items stolen were on sale, should the value be the retail or sale price? I ask this because it could make the difference betw the charges of Class B and Class C misdemeanor. (I think) Also, if this is first offense for both, what kind of punishment can we expect? (worst case/ best case scenerio ) Bail was set for $500 and I bonded him out. (first in Humble PD then taken dwntwn to Harris County)First court date is set for Jan. 11th. Do you recommend we appear on this date with an attorney? Thanks for your advice.

I would recommend getting an attorney since it sounds like you want either a deferred probation or a pre-trial diversion so that your son does not end up with a conviction on his record.
