Legal Question in Criminal Law in Texas
Does signing a nonprosacution affidavet in any way sat that u wee lying are that it didn't happen? My husband who has done nearly a year in County for a burg of hab with intend against me. I did not call the police but someone else did. I told all concerned from the start that i was not pressing charges and i would not testify if it came down to it, i just wantd to be left alone i'd been throug enough. Now he's calling & writing telling me to please sign it and they will drop chrgs. He did what i said i didn't li then and i'm not going to lie now, so if thats what it would mean i wouldn't want to sign it. I just want it all to be ovr i've been through so much for th last 4-5 yrs and my health is bad but i won't lie about it either. Thank you

Normally speaking, all that an affidavit of non-rosecution says is something to the effect of you do not want him to be prosecuted for the charged offense, though you realize the final decision on that is up to the prosecutor. It does not mean that it didn't happen, just that you would prefer he not be prosecuted for it.
