Re: simple assualt of family member
Domestic violence cases are very tricky. Depending upon the jurisdiction handling the charges, family members can be prosecuted to the fullest extent of the law, or have their cases dismissed.
The first step is to find a qualified criminal defense lawyer to advise you how to proceed in your jurisdiction. Often the alleged victim of a domestic violence case can approach the prosecutor and ask that the case against their loved-one not be pursued. This request is not binding upon the State's attorney, but is a good place to start.
Next, the prosecutors do not want family members in conflict with one another. Consequently, individual, couples, or family counseling is a next best step. Most importantly, don't get into any more physical altercations with your family member while charges are pending.
Finally, have patience with the system and work closely with your lawyer to resolve the matter satisfactorily.
