Legal Question in Criminal Law in Texas

My sisters ex-boyfriend has made several threats to her since they broke up 3 years ago, including a death threat "i will take you out". Can I press charges against the exboyfriend or my sister press charges and if so could he go to jail for this? I had a cousin die from domestic abuse and I am trying to do this the right way but it is wearing thin here. Please any advice you have will be greatly appreciated!

Yes; this conduct likely constitutes a Terroristic Threat. This is a Class B misdemeanor carrying up to 6 months in jail or up to 2 years of probation. After contacting the police, your sister should contact the local County/District Attorney about filing for an Emergency Protective Order as well as a permanent Protective Order.

I do not believe you can press charges because you are not the alleged victim. However, if your sister believes that she is in danger she should immediately go to the district attorney's office for assistance. Most district attorney's offices have victim's advocates that can walk the victim through the process of getting a protective order, filing charges, and obtaining any services that may be needed.
