Legal Question in Criminal Law in Texas

My son was arrested and charged with a class a class a misdemeanor for burglary of a vehicle and was put on probation for a year. With only a month left to go on it he was arrested for burglary of habitation he is currently in county jail and was appointed an attorney. I want to know what can happen to him and should I hire an attorney? I live in Texas

For the BMV he can receive up to 1 year in the jail. For the burg of a hab, it depends on his intent when he entered. If he intended to commit theft, then it is a 2nd degree felony and he could get up to 20 years in prison; if he intended to commit assault or a felony then it is a first degree felony and he can get up to life in prison. Realistically he can expect his misdemeanor probation to be revoked. What will happen on the felony really will depend on the circumstances. Perhaps if they won't give him deferred on that, they will consider shock probation.
