My son was arrested Wednesday night for theft $500-1500. On his 3rd day on the job at Kohls in Pasadena,

TX , he is accused of scanning items for less than their price.. He was questioned by the store manager and a loss prevention specialist, watched video of the alleged transactions and after not confessing to setting up and deliberately doing this act, he was arrested and his car impounded. He states he is innocent, and has never seen the customers before. I posted bond and now need advise. My son has a clean record and I need to help him keep it.

Well, you really need to hire a lawyer and fight these charges. This is a serious accusation. It is considered a Class A misdemeanor with a punishment range of up to 1 year in jail and a $4,000 fine. While it is doubtful you son would receive the maximum punishment since he has a clean record, it is important that you understand the seriousness of his situation.

I would suggest contacting a few attorneys and speaking to them, find one you are comfortable with. The attorney-client relationship is very important. Your son needs to be able to trust his lawyer. Since this offense looks like it took place in Harris County, I would also suggest you hire someone who is a member of the Harris County Criminal Lawyers Association (HCCLA).
