Legal Question in Criminal Law in Texas

My son has not been charged with a crime yet but he knows the charges are pending. It was vandalism and the $ amount constitutes a felony charge. He is about to be homeless in Texas - can he leave the state? He has not been arrested yet. I want to go get him and bring him to Colorado.

If he has not been charged, does not have a bond, and there is no court order demanding that he stay in the State of Texas, then there is not anything keeping him in Texas. If charges are filed, they will issue a warrant for his arrest that will be pending over him. It also wont look real good if it comes out that he left the state during the investigation.

Why not look into what you can do to help your son make restitution? Suggest you hire an attorney for him. He can explore the things that must be done to improve your son's position.

The cost of hiring an attorney and loaning your son money to pay restitution should be far less than the costs of fines, court costs, and probation fees. He will have to make restitution anyway.
