Legal Question in Criminal Law in Texas
My son and I own a 1967 Ford Mustang. In April, he paid $2000 to have a "friend" paint the car. After several weeks of procrastination, my son was unable to contact this individual. My son finally went to the shop where the work was being done and the car was gone. He tried to find the individual doing the work, talked to his mother and his father, but noone knows where he is. We have been told by the police that we can't report the car stolen because my son gave him the car to paint. What can we do?
1 Answer from Attorneys
I am surprised by the response of the police department. Before giving up on a theft charge, talk to an investigator with the District Attorney's office, and find out if there is different opinion. If you still can't get a criminal charge filed, file a civil suit against the individual, and possibly the shop where the work was being done. There may be enough of a connection with the shop to hold them responsible.
