Legal Question in Criminal Law in Texas

My son has been in jail since March 8, 2010, he has been assigned a lawyer by the court, this attorney has not contacted my son at all since he was assigned to him, there has been two court dates and the attorney has failed to show up on either date, but the attorney called my son's wife and advised her that he has met with the DA and there is an offer on the table, but how can he effectively work my son's case if he never talks to him to get an idea of what happened from my son, the attorney does not return any calls to his office and never there to take a call, What can my son do?

Unfortunately, this is not uncommon. You can solve the problem by hiring a lawyer for him. Your son can ask the court for a different appointed attorney, which may or may not be granted. If it isn't then, of course, he has the attorney that he has openly criticized. Practically speaking, it is a hard choice to make. Court-appointed attorneys normally have reviewed the file, and have assessed the strength of the DA's case against him. To recommend a plea without speaking to your son however, is difficult to understand. Consider hiring him a lawyer.
