Legal Question in Criminal Law in Texas
my son was jumped by 2 guys at a bar, he received a concusion a broken nose several stitches he also got a disorderly conduct ticket just like the 2 guys that jumped him.the two that jumped him recieved no injuries because he could not fight back. we want to file assault charges against the two guys and the local police said we cannot because they all received the same ticket. One of the guys got arrested last week for the same charge. my son has several thousand dollars in medical bills from this. also on the ticket they have all my son's info on the ticket but not his name they put the name of one of the guys who jumped him. do we have any recourse and is it worth getting a attorney to try and fix this situation. we are suppose to go before the judge next wednesday.

A lawyer cannot file charges. However, if the attacker has money, you can hire a lawyer to sue the attacker. It does not matter who got what ticket; what matter is that the guy caused injuries (assuming that your son is not responsible for the incident. If your son started it or was a real part of it, he is equally responsible for his own injuries.)
