Legal Question in Criminal Law in Texas

My son recieved two tickets for possession of narcotic paraphanelia in one week. He also received a ticket in 2008 for the same offense. He is 19 and we live in Texas. I know it is a class c misdemeanor and if he pays the fine for both it will stay on his record. But I am concerned that since this is the 3rd offense will the fine be more or will he have to do jail time ?

Based on what you have written, it ultimately depends upon the specifics of the facts within your son's case. Generally, the more times an individual is charged with a certain crime the more punishement can be accessed based on an enhancement. If it is still being charged as a Class C Misdemeanor, then the max fine is $500.00 but the judge may order other items to be completed. You may want to consider consulting with a local law firm to ensure that you are fully protecting your son's rights and interests.
