Legal Question in Criminal Law in Texas
My son and his wife got in an argument and he pushed her to the ground by her neck. My ex brother in law was the arresting officer and told my daughter in law that he would be charged with a felony. My daughter in law says he did not act like a cop, but like it was personal and we are questioning the validaty of the felony charge. My son goes in front of the judge tomorrow so should he plead not guilty if the charge is presented as a felony?

It is a felony only if the complainant says that her breathing was impeded, or your son has a prior conviction / probation for assault on a family member. He needs a lawyer.
