Legal Question in Criminal Law in Texas
Stalker Ex-Boyfriend
My ex and I have been broken up for about 2 months. During our relationship I allowed him to spend the night with me a couple of times. Now that we have broken up he is stalking me. He breaks into my house by bursting out windows and kicking in my door but whenever I call the police they never do anything because they sau since I allowed him to spend a few nights he is now considered to be a resident of the household. I live in an apartment complex and e is not on my lease, he also has a trespassing warning, so he is not even suppose to be on the property so why can't they help me? I was advised that I had to evict him from my home and I had to give him at least a 30 day written warning that he has to vacate, but how can i evict someone who doesn;t live there and what happens if he hurts me within those 30 days? I can't even get a restraining order on him because they consider him a resident. He abuses me and when asked what will happen if I harm him one of the times he kicks my door in i was advised that charges would be filed on me even though it's self defense. I am lost and do not know what to do at this point, can someone please help me?

If this is a complete and accurate account of what has happened, then there is something terribly wrong with the law enforcement response you have received. Since the police have not responded, try taking your matter directly to the district attorney's office to see if they will accept charges. Speak to an investigator. If that still fails, consult with an attorney in your area, who for a minimum fee, would intervene on your behalf. Good luck.
