Legal Question in Criminal Law in Texas

Stalking and Harrasment

For the past year, I have been stalked, harrased, threatened, and videotaped by a convicted felon, with a history of mental illness, gun violence, violence against women, and heroin addiction. The Wood County Sheriff's Dept. has refused to take any reports from me about this man's actions, and many times they have threatened me with arrest. Recently, when I contacted them about him harrasing my elderly mother, they put me in jail and charged me with a crime -- disorderly conduct -- saying that the man had called them and told them that I went onto his property and threatened to assault him. This is an example of the false reports he makes to the Sheriff's Dept. as one way of harrasing me. The DA's office refused to help me, saying that I have to work with the Sheriff's Dept. to report the man's harrasment, but since they refuse to take a report, there is no record in their department of all the calls I have made to them about this man harrasing me. I have also contacted other agencies for help, but everyone keeps telling me to press charges against this man through the Sheriff's office. I'm getting nowhere with this problem, and it is ruining my health, my sanity, and jeopardizing my job. Please advise.

Re: Stalking and Harrasment

Since you have exhausted the law enforcement aspect of this situation without success, I would advise you to hire a lawyer and get a restraining order. Through the civil process you can stop him from bothering you, and you will have a court order that will get him arrested if he violates it. Moreover, as the case becomes more visible to the civil judge, you will have the 'teeth' to force the local law enforcement to take action.
