Legal Question in Criminal Law in Texas

In the state of texas there was passed a law called " romeo and juliet" law. My question is my daughter is 14 and will be 15 in 8weeks and her boyfriend for the last year turned 18 yesterday. Well 8 weeks ago my daughter became pregnant. So he was 17 when that occured. I dont want to see him get in trouble cause he is a good kid. As a matter of fact he will b a senior this up coming year and she is going to be a freshman. And they are in love. So do they fall under this "romeo and juliet" law or is he in jeopardy of criminal charges by the state?

It is a crime for anyone to have sex with a child under 17. A child under 17 cannot consent at all. There is a defense if the two are not 1 day more than 3 years of age apart. If more than 3 years of age apart, then he can be charged with sexual assault of a child.
