Legal Question in Criminal Law in Texas

What is the statue of limitations on a misdeamor warrant?

I have a warrant in the state of Texas for wriing 4 bad checks.None are over $70.00 ane it was from prior to 2001. I have relatives in Texas but I am afraid to visit in case I will be stopped.I had a court date but moved from the state before the date. I had tried to tell the court that I was moving and to let me pay for them before but they said no. It's a little hick town. thanks

Re: What is the statue of limitations on a misdeamor warrant?

If there are valid warrants outstanding, and you left the state, then the statute of limitations or laches will not apply. Caselaw tends to uphold the proposition that by being out of state, the statute is tolled.

You are correct to stay away until this gets resolved. Often a Class C misdemeanor and FTA warrants can be resolved without you being present. Contact a local attorney to get the matter resolved.
