Legal Question in Criminal Law in Texas
What is the statute of limitation in Texas for assault?
2 Answers from Attorneys
If this is a Class A misdemeanor assault, then the State of Texas has 2 years from the alleged criminal act to file charges against a person. If we are talking about a felony assault, then the State has three years from the date of the offense.
It ultimately depends upon if the assault is a misdemeanor or felony. Misdemeanor Assault, which could be a Class C or Class A (based upon the specific facts), has a two (2) year statute of limitations. Felony assault, depending upon what specific assault could be anywhere from no limitations period to three (3) years.
