Two years from the offense date if it would have been filed as a misdemeanor, three years if a felony (back then, that would have been only due to enhancement because priors for the same thing). Unless you were out of state for the last ten years plus, there's no way it can be filed now, and if you were arrested and never charged, or the case was dismissed and never refiled within the SOL, you'd qualify now to have the arrest expunged so that it won't show up on a background check.
