Legal Question in Criminal Law in Texas

statute of limitations on revocated probation

It was about 2 years ago on probation for posession of marijauna under 2 oz. I chose to take the probation rather than enter a plea of guilty and spend a few weeks in the pokey. halfway through I moved out of the country that was almost 2 years ago. a letter was sent to my parents house during my absence 3 days before the year of probation was up january 24, 2005. my question is when if ever does statute of limitations occur with this type of offense, ie time period and begininning from what point. also as a side note if i were to return to the country what would the offense warrant at this stage.

Re: statute of limitations on revocated probation

Based upon the information you provided, there is a warrant for your arrest.

There are very unusual cases, where the warrant is quashed because the PO/law enforcement did not exercise due diligence in executing the warrant. Doubtful you would be successful in this effort, however, since you were out of the country.

You or your parents should retain an attorney in the county where the warrant was issued, to determine the best and worst case scenarios if you were to return.
