Manufacture or Delivery of a Controlled Substance which falls in penalty group 3 or 4 in an amount greater than 28 grams but less than 200 grams. In Texas, different substances fall in different "penalty groups." For example, cocaine is considered penalty group 1. The most common substance I deal with in penalty group 3 is Xanax.
This offense is considered a 2nd degree felony punishable by 2-20 years in prison and up to a $10,000 fine.
