Legal Question in Criminal Law in Texas
I'm suppose to appear in court later today. I was driving thru a town in which I do not live and was pulled over by a city cop who apparently was in a big hurry--he wrote me a ticket for "swerving" which I argued that I had not done, and his response was that he didn't have time to listen to me...he was writing the ticket and that was that. After he handed me the ticket & quickly sped off, I noticed that he had added that I was "typing a report" while driving...??? I do not type any reports with my job and do not have any equipment in my truck to type with even if I wanted to! He also wrote that I was driving an '03 White Chevy truck when actually I was driving an '04 White Dodge truck. I do not even own an '03 White Chevy truck. I took the ticket to that town's city offices/court and told the clerk I wanted to schedule a day in court to fight the ticket instead of paying the $140 fine. She looked at the discrepancies and actually pointed out a few other things on the ticket that the cop had done incorrectly. She stated "He really must have been in a hurry!" She called the judge on the phone to see about just having the ticket dismissed because of all the mistakes and the judge's response was, after she asked if I was a DOT driver & I said yes, "I can't dismiss the ticket but what I can do is tear that one up and re-write another ticket for 'dark window tint' so that it is not a 'moving violation'...basically telling me that they would just fraudulantly lie so that I had to pay the $140 fine (the window tint and the swerving fines are the same in that town apparently). I am suppose to be in court today to take care of the matter but would rather pay whatever it takes to a lawyer to get this mess dropped than to pay this dishonest town a dime! I'm pressed for time so looking for any attorney that can help in the San Augustine, Texas area. I have to respond to them by today 5/11/11. Any advice would be appreciated.
