can a suspended police officer in the state of texas use a post suspention recording that was made with out the others consent in an executive hearing to determine the termination of his employment

This is not a criminal law question. Please repost under administrative hearings or something.
FYI, a person can record any conversation to which they are a party in Texas. Because the cop was in the room, s/he can record whatever s/he wants. Whether it could be used to appeal is another matter.
