Legal Question in Criminal Law in Texas
Taking the 5th
I've been subpoenaed to appear in court as a witness. If I take the fifth will there be consequences? I've already been asked questions by the prosecutors, and yes I have answered some questions. But if I take the fifth on the stand will there be consequences?

Re: Taking the 5th
I always advise a person to pay the minimum retainer to hire a lawyer, to advise the court that the witness will not respond to questions and will invoke. In this circumstance, the judge will make a determination, outside the presence of the jury, and often will refuse to even allow the witness to take the stand.
Whether you are criminally responsible for any actions, and whether that will result in charges against you would be pure speculation.
