Teacher Filing Charges of physical assualt by a 14 year old minor

There was a fight in a school cafetaria where a teacher was pushing her way to the fight. My granddaughter was in the way and the teacher pushed her in the chest nocking her to the floor yelling get out of the way. My granddaughter did not see her at first with all the students milling around. When this happened with being nocked over by the teacher, she call the teacher a bitch, but did not touch her. My granddaughter immediately stated that she called the teacher a name after being hit, but that was it. The teacher stated she was assaulted by my granddaughter physically. The school tape was looked at and there was no way it could be determined and the altercation was not seen on camera. My grandchild was served a notice to appear in court and it is said a fine wil have to be paid. I think the teacher is lying to protect herself after she realized she assaulted a child, so took the upper hand and said she was assualted instead. I would like to represent my grandchild and she is willing to take a lie detector test as well to prove she did not hit the teacher. I have all kinds of wittnesses as to the character of my grandaugher as well as a couple of other students that will testify that the teacher was the one who hit.

Is the notice to appear for municipal court? If so, you should be able to take your granddaughter and tell your story to the judge. Most JP and Municipal judges are very lenient with the presentation of cases by non-lawyers. If it goes badly however, and you want to appeal it, you have to do it within three days -- so be prepared to hire a lawyer in that event.
