Legal Question in Criminal Law in Texas

Terry, from Phoenix Arizona was contacted to send money to Marlene, in Nigeria. Terry can't send money so Marlene asked Terry to send money ( Western Union ) to me, which I, in turn sent to Marlene, in Nigeria. In the middle of a second, similar transfer, Marlene told me to keep the money ( $ 150 .00 ). Now, she has changed her tune, told Terry that I stole the money. Terry, in Phoenix, has had an attorney send me emails threatening to charge me with theft, and to have me put in jail. There is a yahoo messenger transcript that shows that Marlene said I could keep the money.

Can they put me in jail ? I live in Houston Texas. Please advise, thank you.

If there is an email that exists that states: "keep the money" more-than-likely, they will not be able to collect this money from you in any suit. Of course, they can sue you in small claims court, but the email is proof that the money was given to you.

Keep the email.
