Legal Question in Criminal Law in Texas
Texas Civ. Prac. & Rem. Code 134.001
My 14 year old daughter was charged with shop lifting. All property was returned but a law firm/collection agency is threatening to take me (the parent) to court unless I pay them a substantial amount of money. Do these cases make it court if I don't pay? What is the best way to fight it? Are their statistics and case information about these types of trials and how the judges rule? It seems like it is a intimidation tactic to grab $500. Any information you could provide would be helpful.

Did the criminal charge result in restitution? If so, they cannot collect twice. If not, ask for them to substantiate the amount they are demanding. Offer what you consider a reasonable settlement, and make sure that it is noted as payment in full.
