texas early termination probation procedure
I have just completed my 5th month of a 2 year deferred ajudication sentenence. It is misd theft charge. I am unable to get a job anywhere. I have paid the restitution, completed community service, but because I am unable to get a job, I cannot pay the 2500 court fine they charged me. At what month in my probation can I ask for a termination? I need to get an attorney that will fight for me and relay to the courts that this is costing my livelihood and without a job, I cant pay this steep fine. HELP!

Hello there,
You should file a motion with the court asking for your probation conditions to be modified due to you inability to get a job.
During the hearing your should simply inform the judge how you have tried to get a job but for what ever reason you cannot. You need to have proof that you have tried to obtain a job in the form of a list of employers that you tried to obtain a job from.
During the hearing you should ask the judge if he could lower or waive your court cost/fine.
Before I was an attorney I was a probation officer and I requested this for my probationers when they could not pay and the judge went along with my request.
You should take the information I have give you to a local legal aid office where you live. They may be able to help you with the motion.
