Legal Question in Criminal Law in Texas
Why did texas hold her?
My wife was arrested on friday in texas for a warrant out of missouri. On friday texas officials said missouri will extradite so we will hold your wife. On monday afternoon texas officials said missouri wouldnt extradite and released her, no paperwork have a nice day. Are texas officials allowed to do that? According to case website there is a warrant, but that is a whole different set of questions. Thanks for your time.

Re: Why did texas hold her?
Texas was allowed to take her into custody because there was a valid outstanding warrant. They then have to follow a specific procedure to determine if the issuing state is going to pick her up. It appears that they did that, but that the issuing state backed out. So they released her.
